Lilibetta Website Terms and Conditions of Use

1. General

 

The Lilibetta website at www.lilibetta.com (the "Website") is operated by Eduard Boyko, Licensed Dealer No. 321210247, who operates the Lilibetta brand ("Lilibetta" or the "Business").

 

The Website is an online store offering bags, jewelry, bag accessories, scarves, twillies and related fashion accessories for sale.

 

Browsing and using the Website, including making a purchase through it, are subject to these Terms and Conditions of Use (the "Terms") and to Lilibetta's Privacy Policy, as updated from time to time and in accordance with the law. The user is asked to read the Terms carefully before using the Website and placing an order.

 

If the user does not agree to the Terms, in whole or in part, she should refrain from using the Website. Use of the Website constitutes acceptance of the Terms that apply to browsing and using it. Completing an order on the Website is conditional on expressly accepting the Terms and the Privacy Policy by ticking the designated checkbox during checkout.

 

These Terms also apply, with the necessary changes, to remote orders placed through Lilibetta's other sales channels, including by phone, WhatsApp, Instagram, Facebook or any other means of communication Lilibetta uses for sales. A purchase made in person is subject to the applicable law and to the terms presented at the time of purchase.

 

Purchases on the Website may be made by a person aged 18 or over who is legally competent to enter into a binding legal transaction, holds a valid means of payment registered in her name or that she is authorized to use, and has an active email address and phone number.

 

Lilibetta may update, add to or change the Terms from time to time, subject to the law. The current version will be published on the Website and will show the date of the last update. Each order is governed by the version of the Terms in force at the time it was placed, and changes to the Terms will not apply retroactively.

 

Lilibetta may from time to time update the structure, design and content of the Website and the products and services offered on it, and may carry out technological changes, maintenance and updates, all subject to the law.

 

The user is responsible for providing complete, correct and accurate details as required for placing an order, payment and delivery of the products. Subject to the law, Lilibetta may prevent use of the Website or cancel an order in the event of unlawful use, an attempt at or reasonable suspicion of fraud, provision of incorrect details, unauthorized use of a means of payment, an attempt to harm the Website or its systems, or use that harms Lilibetta, other users or third parties.

 

These Terms apply equally to all genders.

 

Nothing in these Terms derogates from any right granted to the user by law, and in the event of a conflict between a provision of the Terms and a mandatory provision of law, the provision of law shall prevail.

 

2. Definitions and interpretation

 

For the purposes of these Terms, the following terms shall have the meanings set out next to them, unless the context requires otherwise:

 

"Website" – Lilibetta's website at www.lilibetta.com, including product pages, the shopping cart, the ordering interface and any page or service offered through it.

 

"Lilibetta" or the "Business" – Eduard Boyko, Licensed Dealer No. 321210247, who operates the Lilibetta brand.

 

"User" – anyone who browses or uses the Website, places an order through it or contacts Lilibetta to purchase a product through one of the Business's remote sales channels.

 

"Product" or "Products" – any product offered for sale by Lilibetta, including bags, jewelry, bag accessories, scarves, twillies and related fashion accessories.

 

"Order" – a request to purchase a product or products, made through the Website or another remote sales channel of Lilibetta, in accordance with these Terms.

 

"Business day" – Sunday to Thursday, excluding holiday eves, holidays, election days and official days off in Israel.

 

Where the context requires, a term in the singular includes the plural and vice versa.

 

Section headings are for convenience of reading only and do not affect the interpretation of the Terms.

 

3. Purchasing products through the Website

 

The Website allows users to purchase the products offered on it, subject to stock availability and to these Terms.

 

An order is placed on the Website by selecting the desired products and adding them to the shopping cart, providing the details required for the order and delivery, reviewing the order details and the total price payable, accepting the Terms and the Privacy Policy, and making payment.

 

Before completing the order, the user is responsible for checking the order details, including the selected products, quantity, color or model where relevant, delivery details and the total price payable.

 

Payment on the Website is made by credit card and/or other means of payment shown on the payment page at the time of the order. Payment is processed by an external payment provider. Full credit card details are not stored by Lilibetta.

 

After the order process is completed, the user will receive an automatic message confirming that the order details have been received. This message does not necessarily constitute final confirmation of the order. The order will be considered confirmed once payment has been approved and the availability of the ordered products has been verified.

 

Once the order is confirmed, a document containing the transaction details as required by law, as well as a tax invoice/receipt as applicable, will be sent to the user by email.

 

If an ordered product is out of stock, Lilibetta will inform the user as soon as possible. Lilibetta may offer an alternative product, but no substitution will be made without the user's consent. If the user does not want the alternative product, the charge for the product will be cancelled or the full amount paid for it will be refunded, as applicable.

 

If an error was made in good faith in the description, price, availability or another material detail of a product, Lilibetta will inform the user as soon as possible and allow her, as applicable and in accordance with the law, to complete the transaction on the correct terms or to cancel it and receive a full refund of the amount paid.

 

The user is responsible for providing complete and correct details required for the order, payment and delivery. Providing incorrect or incomplete details may delay or prevent completion of the transaction or delivery of the products.

 

Subject to the law, Lilibetta may decline or cancel an order if payment was not approved, the product is unavailable, incorrect details were provided, there is a reasonable suspicion of fraud or unauthorized use of a means of payment, there is another obstacle to completing the transaction, or the user has breached the Terms. If payment was collected for an order cancelled in this way, the amount paid will be refunded to the user in accordance with the law.

 

The products offered on the Website are intended mainly for personal use. Lilibetta may limit the number of units of a particular product that can be purchased in a single order, provided that such a limit is shown to the user before the order is completed.

 

4. Pre-orders

 

Certain products may be offered on the Website as pre-orders. For these products, the estimated delivery date will be shown on the product page, where it can be determined in advance.

 

The delivery date of a pre-ordered product may differ from the Website's regular delivery times. In the event of a delay beyond the delivery date provided to the user, Lilibetta will inform her as soon as possible. If the product is not delivered on the set date, the user may cancel the transaction in accordance with the law and receive a refund of the amount paid for the product.

 

5. Prices, promotions and vouchers

 

All prices shown on the Website are in New Israeli Shekels and include VAT as required by law, where applicable. Shipping fees, where applicable, are shown separately during checkout, and the total price payable is shown to the user before the purchase is completed.

 

The binding price for each product is the price shown on the Website at the time the order is completed. A change in the price of a product after the order is completed will not apply to an order that has already been completed.

 

Lilibetta may from time to time update product prices, shipping fees and the terms of promotions and benefits, subject to the law. Such updates apply from the time they are published on the Website and do not affect orders already completed.

 

If the Website contains a typographical error, technical error or obvious error in the price, product description or another material detail of the transaction, Lilibetta will inform the user as soon as possible and allow her, where relevant and in accordance with the law, to choose between completing the transaction on the correct terms or cancelling it and receiving a full refund of any amount paid.

 

Promotions, discounts, coupons and benefits are valid according to the terms and period published for each promotion. Unless expressly stated otherwise, promotions, discounts or coupons cannot be combined and cannot be exchanged for cash.

 

If a transaction in which a product was purchased at a promotional price is cancelled, the refund will be calculated according to the price actually paid for the product. If a gift or benefit was given conditional on the purchase, the terms published for that benefit will apply in the event of cancellation, subject to the law.

 

If Lilibetta issues gift vouchers or gift cards, their terms of use, validity period and method of redemption will be set out on the voucher or in accompanying terms, all in accordance with the law.

 

6. Shipping and delivery

 

Orders placed on the Website are shipped to the address provided by the user when placing the order, through a courier company Lilibetta works with, in accordance with the delivery areas and delivery terms set out on the Website.

 

Unless stated otherwise on the product page or during the ordering process, delivery time is up to 7 business days for standard shipping and up to 2 business days for express shipping, from the date the order is confirmed. In remote localities or areas where the courier company has operational limitations, delivery time may be longer, provided this is shown to the user before the order is completed.

 

Standard home delivery costs ₪35 per order, and express home delivery costs ₪49 per order. Standard shipping is free on orders of ₪1,000 or more. This applies unless otherwise published on the Website as part of a promotion or specific purchase terms. Shipping fees will be shown to the user before payment.

 

Free self-pickup is available from the business address: 121 Dvora HaNevi'a St., Building 4, 13th floor, Tel Aviv-Yafo 6944038. Pickup is available during customer service hours, by prior arrangement and only after receiving notice from Lilibetta that the order is ready for pickup.

 

When picking up an order, the order number and an ID document must be presented. Another person may collect the order on the user's behalf, provided they present the order number and written authorization from the user, including via WhatsApp.

 

The user is responsible for providing a complete and accurate delivery address and contact details and for being available to coordinate delivery. If a shipment is returned to Lilibetta because incorrect details were provided or because the user repeatedly could not be reached, Lilibetta may charge the cost of re-shipping according to the actual cost, after notifying the user.

 

An order may be sent as a gift to an address other than the buyer's. At the user's request, the shipment will not include price details.

 

We recommend checking the packaging and the product soon after receiving them. In the event of visible damage, we recommend contacting customer service as soon as possible and attaching photos of the product and packaging. This does not derogate from the user's rights under the law.

 

Delivery times may be affected by circumstances beyond Lilibetta's control, including the security situation, emergencies, holidays, or malfunctions or delays on the part of courier companies, authorities or infrastructure providers. In the event of a significant delay in delivery, Lilibetta will inform the user. If the product was not delivered on the set date, the user may cancel the transaction in accordance with the law.

 

7. Cancellation of a transaction

 

Cancellation of a transaction is carried out in accordance with the Consumer Protection Law, 5741-1981, the regulations enacted under it and any other binding law. This section sets out Lilibetta's cancellation policy and does not derogate from any right granted to the user by law.

 

The user may cancel a distance sale transaction from the date of the transaction until 14 days from the date of receiving the product or the date of receiving the document containing the transaction details, whichever is later.

 

A user who is a senior citizen, a person with a disability or a new immigrant, as these terms are defined by law, may cancel the transaction within four months of the date of the transaction, the date of receiving the product or the date of receiving the document containing the transaction details, whichever is later, provided that the transaction involved a conversation between Lilibetta and the user, including a conversation via electronic means of communication. Lilibetta may request a document proving eligibility for the extended cancellation period.

 

Notice of cancellation may be given orally or in writing, by any of the following means, as well as by any other means through which the transaction was made: through the "Cancel a Transaction" form on the Website, attached to these Terms as Appendix A; by email to info@lilibetta.com; by phone or WhatsApp at +972-50-7637722 during customer service hours; or by registered mail to 121 Dvora HaNevi'a St., Building 4, 13th floor, Tel Aviv-Yafo 6944038.

 

The cancellation notice must include the user's name and ID number. We also recommend stating the order number, if known, to help identify the transaction and handle the request quickly.

 

The right of cancellation does not apply in cases where the law does not grant such a right, including for a product made or adapted specifically for the user following the transaction, such as a product with engraving or personalization.

 

Opening the product packaging does not in itself cancel the right of cancellation. The user is asked to return the product in the condition in which it was received, as far as possible in its original packaging and with the labels and accessories that came with it. This does not condition the right of cancellation itself, and Lilibetta reserves its rights under the law if the product has been damaged or its condition has deteriorated.

 

If a transaction is cancelled for reasons other than a defect, non-conformity, late delivery or another breach on Lilibetta's part, Lilibetta may charge a cancellation fee of 5% of the product price or ₪100, whichever is lower.

 

In such a case, the user must return the product to the business address by prior arrangement, or send it to this address by registered mail or courier, at her own expense. At the user's request, Lilibetta may arrange courier pickup of the product from her address for a fee of ₪45.

 

If the cancellation results from a defect in the product, a discrepancy between the product and the details provided to the user, failure to deliver on the set date or another breach of Lilibetta's obligations, no cancellation fee will be charged and the user will bear no cost for returning the product. In this case, the user will make the product available to Lilibetta at the place where it was delivered to her, and Lilibetta will arrange its collection at its own expense.

 

Lilibetta will refund the user the amount paid, less the cancellation fee where applicable, within 14 days of receiving the cancellation notice and in accordance with the law. The refund will be made, as far as possible, to the means of payment used for the transaction.

 

Refunds will be made in money and not as credit toward a future purchase, unless the user has expressly requested or agreed to receive such credit.

 

8. Exchanges

 

In addition to the statutory right of cancellation, Lilibetta allows products to be exchanged within 14 days of receipt, subject to the conditions below.

 

An exchange is possible if the product is new, unused, has its original labels and is in its original packaging, if any, and subject to the availability of the requested product.

 

If the replacement product costs more than the returned product, the user will pay the difference. If it costs less, the difference will be given as credit toward a future purchase.

 

Shipping costs for an exchange that is not due to a defect or non-conformity are borne by the user.

 

For hygiene reasons, earrings that have been removed from their packaging cannot be exchanged unless they were received damaged. This restriction applies only to Lilibetta's exchange policy and does not derogate from any statutory right of cancellation.

 

The exchange policy is a benefit provided by Lilibetta and does not derogate from any other right granted to the user by law.

 

9. Defective products, non-conformity and warranty

 

Lilibetta undertakes to supply products that match their description on the Website and comply with the law.

 

If a product received is defective, missing, different from the product ordered or materially inconsistent with its description, please contact customer service as soon as possible, stating the order number and a description of the problem and, if possible, attaching photos of the product and packaging.

 

Lilibetta will review the request and act according to the circumstances and the law. If a defect or non-conformity is found, an appropriate remedy will be provided, including repair, replacement or a refund.

 

Where a commercial warranty is provided for a particular product, the warranty period and terms will be set out on the product page or in an accompanying document.

 

The warranty does not cover natural wear and tear, including wear or fading of plating; damage caused by use not in accordance with the product's purpose or care instructions, improper storage, exposure to water, moisture, perfumes, creams or chemicals, or excessive strain; alterations or repairs made by anyone not acting on behalf of Lilibetta; or loss or theft.

 

10. Jewelry re-plating

 

Lilibetta jewelry, excluding bag accessories, comes with a first re-plating free of charge.

 

From the second re-plating onwards, the cost is ₪250, unless otherwise published.

 

To preserve the plating, we recommend storing jewelry in a dry place at room temperature and avoiding contact with water, moisture, perfumes, creams and chemicals as much as possible.

 

11. Liability regarding the Website and its content

 

Lilibetta makes reasonable efforts to present accurate, up-to-date and clear information about the products and services offered on the Website. However, there may be errors, inaccuracies or differences in how products are displayed, including due to screen settings, photography conditions, lighting or information updates.

 

Lilibetta does not guarantee that the Website will be available at all times, uninterrupted or free of faults, and may carry out maintenance, upgrades and updates from time to time.

 

Lilibetta takes reasonable and customary measures to maintain the security of the Website and the information processed through it. However, it is not possible to guarantee that online systems will be completely immune to faults, disruptions, intrusions or information security incidents.

 

Subject to the law, Lilibetta will not be liable for indirect or consequential damage caused by use of a product not in accordance with its purpose, unreasonable use, alteration of the product, improper storage, natural wear and tear or failure to follow the care instructions.

 

Nothing in the Terms excludes or limits liability that cannot be excluded or limited by law.

 

12. User account

 

Where the Website allows a user account to be opened, opening an account is not a condition for making a purchase, unless stated otherwise.

 

The user is responsible for keeping her account login details confidential and for taking reasonable measures to prevent unauthorized use of the account.

 

If unauthorized use of the account is suspected, please contact Lilibetta as soon as possible.

 

Lilibetta may suspend or block an account used in breach of the Terms, in the event of suspected fraud, or where necessary to protect the Website, other users or third parties.

 

The user may request to close her account at any time, subject to retaining information that must be kept by law or for handling previous transactions.

 

13. Rules of use

 

The Website may not be used unlawfully or in a way that may harm Lilibetta, other users or third parties.

 

Without derogating from the above, it is prohibited to provide false details or use another person's means of payment without authorization; to operate software, robots, crawlers or automated tools to collect information, images, prices or content from the Website; to disrupt the operation of the Website, bypass security measures or introduce malicious code; or to make commercial use of the Website or its content without prior written permission from Lilibetta.

 

Lilibetta may prevent or restrict access to the Website for anyone using it in breach of the Terms or the law, without derogating from any other remedy available to it by law.

 

14. Reviews, user content and tags

 

Reviews, comments and content published by users on the Website reflect their own opinions only.

 

It is prohibited to publish on the Website content that is false, misleading, offensive, unlawful, promotional, infringes third-party rights, or may harm another person's privacy, good name or intellectual property rights.

 

A user who uploads a review, image or other content to the Website declares that she is entitled to publish it and that its publication does not infringe the rights of any third party.

 

Lilibetta may decline to publish such content, edit it technically without changing its meaning, or remove it if, in its opinion, it breaches the Terms or the law.

 

By publishing a review, image or other content on the Website, the user grants Lilibetta a non-exclusive license to display the content on the Website and on the brand's channels, in the context in which it was published.

 

Images or content published by the user on a social network in which Lilibetta is tagged will not be republished by Lilibetta without the user's consent, where such consent is required.

 

15. Intellectual property

 

All intellectual property rights in the Website and its content, including the Lilibetta name, logo, trademarks, product designs, images, texts, graphics, website design and any other content, belong to Lilibetta or to a third party that has authorized their use, as applicable.

 

It is prohibited to copy, reproduce, distribute, publish, modify, adapt, transfer, publicly display, make commercial use of or create derivative works from the content of the Website, in whole or in part, without prior written permission from Lilibetta or the relevant rights holder, unless such use is permitted by law.

 

Browsing the Website or purchasing a product does not grant the user any right in the intellectual property of Lilibetta or of third parties.

 

Third-party trade names, logos and trademarks appearing on the Website are the property of their owners, and their display on the Website does not grant Lilibetta any rights in them beyond those granted to it for their use.

 

The content of the Website may not be displayed through framing, embedding or any other means that creates the impression that it is part of another website or service, without prior written permission from Lilibetta, unless permitted by law.

 

16. Third-party links and services

 

The Website may include links to third-party websites, platforms and services, and may use external services, including payment providers, courier companies, mailing services, social networks and technology services.

 

Lilibetta does not control the content, availability or operation of external websites and services that are not under its control, and does not undertake to review or approve all content and services offered through them.

 

The inclusion of a link or reference to an external service does not constitute a recommendation, endorsement or representation by Lilibetta regarding that third party, unless expressly stated otherwise.

 

Use of third-party websites and services may be subject to their own terms of use and privacy policies.

 

Lilibetta will not be liable for any act or omission of a third party that is not under its control, except for liability that cannot be limited or excluded by law.

 

17. Privacy and information security

 

Personal information collected through the Website will be used in accordance with Lilibetta's Privacy Policy.

 

The Privacy Policy sets out, among other things, the types of information collected, the purposes for which it is used, the parties who may have access to it, the use of cookies and similar technologies, how the information is stored and the user's rights regarding her personal information.

 

18. Customer club

 

If Lilibetta operates a customer club, joining will be voluntary, and its terms, the benefits offered, the membership period, membership fees if any, and how benefits are redeemed will be set out in separate club regulations or in terms presented to the user when joining.

 

Lilibetta may from time to time update the club terms and the benefits offered, subject to the law and with appropriate notice where required.

 

19. Marketing messages and service notifications

 

Lilibetta may send users marketing messages, including updates, promotions, benefits and event invitations, subject to obtaining the consent required by law.

 

The user may at any time ask to stop receiving marketing messages, using the unsubscribe mechanism included in the message or by contacting Lilibetta.

 

Unsubscribing from marketing messages will not prevent the sending of operational or service messages required in connection with an order, payment, delivery, return, exchange, warranty, security or a customer service inquiry.

 

Such messages may be sent to the email address, phone number or other means of communication provided by the user in the order or inquiry to Lilibetta, all in accordance with the law.

 

20. Accessibility

 

Lilibetta works to make the Website and the services provided through it accessible in accordance with the applicable law.

 

Details of the accessibility adjustments on the Website, accessibility arrangements, alternative ways to receive service and contact details for accessibility inquiries are set out in the Accessibility Statement.

 

If the user encounters difficulty with the accessibility of the Website or in receiving accessible service, she may contact Lilibetta using the contact details set out in the Accessibility Statement.

 

21. Force majeure and circumstances beyond Lilibetta's control

 

Lilibetta will not be considered to have breached its obligations where their performance was prevented or delayed by circumstances beyond its reasonable control, including war, a state of emergency, security incidents, natural disasters, epidemics, strikes, lockouts, failures of communication or computer infrastructure, or delays by courier companies, authorities or other parties not under its control.

 

In the event of such a delay or obstacle, Lilibetta will make efforts to inform the user where possible and take reasonable measures to minimize the impact on fulfilling the order.

 

This does not derogate from the user's right to cancel a transaction or receive any other remedy granted to her by law.

 

22. Governing law and jurisdiction

 

These Terms, the use of the Website and the transactions made through it are governed by the laws of the State of Israel.

 

Jurisdiction over any dispute relating to the Website, its use or a transaction made through it will be determined in accordance with the law.

 

23. Miscellaneous

 

These Terms, together with the Cancel a Transaction form attached as Appendix A, the Privacy Policy, the Accessibility Statement and any additional terms published on the Website regarding a particular product, service, promotion or benefit, govern the use of the Website and the transactions made through it, subject to the law.

 

If a court or other competent authority determines that any provision of the Terms is invalid, unlawful or unenforceable, this will not, to the extent permitted by law, affect the validity of the remaining provisions of the Terms.

 

Lilibetta's refraining from insisting on a right granted to it under the Terms or by law shall not be considered a waiver of that right.

 

Notices and updates regarding an order, payment, delivery, return, exchange, warranty or service may be sent to the contact details provided by the user, including by email, text message, WhatsApp or any other means of communication used in connection with the order or service.

 

The above does not derogate from the provisions of law applicable to sending advertisements and marketing messages.

To cancel an order, please fill out the form below. You can also cancel by email, phone, WhatsApp, registered mail or any means through which the transaction was made.

The "Reason for cancellation" field is optional and is not a condition for cancellation. In the case of a defect, non-conformity or delay, no cancellation fee will be charged.
